Filed in federal court in Chicago, in the lawsuit, Podhurst Orseck attorney Steven Marks alleges that the Boeing 737 Max 8 aircraft was defectively designed with a new flight control system that erroneously pushes the aircraft’s nose down. The suit claims Boeing failed to warn pilots and the public about this dangerous defect, which also led to the Lion Air crash less than five months prior. This legal action is noted as potentially the first U.S. claim related to the Ethiopian Airlines disaster. The lawsuit also implicates the FAA, suggesting it improperly delegated certification authority to Boeing, contributing to flaws in the aircraft’s safety analysis.
