In response to a growing number of lawsuits against insurance companies, attorneys are seeking to consolidate all COVID-19 business-interruption cases into a single multidistrict litigation (MDL) proceeding. Dozens of small businesses have sued insurers like Lloyd’s of London, Chubb, and others, for denying claims for economic losses resulting from government-mandated shutdowns during the pandemic. Two groups of lawyers have filed motions with the U.S. Judicial Panel on Multidistrict Litigation, proposing either Philadelphia or Chicago as locations to centralize the cases. While some attorneys, such as Richard Golomb, argue an MDL is the most efficient path to a fair resolution, others, like Steven Marks of Podhurst Orseck, express concern that an MDL could be unmanageable due to the volume of claims and differences in insurance policies.
