October 2025 – A flight from Cancun, Mexico to Newark, New Jersey was diverted to Tampa, Florida on October 30th after the Federal Aviation Administration said the crew experienced a flight control issue.

“When an aircraft loses a lot of altitude against the inputs of the pilots and the pilots aren’t able to keep the aircraft level, we’ve seen what the tragic consequences of that can be from the Boeing 737MAX crashes from several years ago,” said Pablo Rojas, attorney at Podhurst Orseck.

According to fire rescue officials, more than a dozen people were taken to Tampa hospitals to be treated for injuries.

“This is more than severe turbulence. Everything indicates this flight was not in severe weather,” said Rojas.

Reports from some passengers show the aircraft was in a nosedive sustained over several seconds. According to JetBlue, the Airbus 320 was taken out of service for inspection.

Passengers who were aboard JetBlue Flight 1230 may seek legal representation. Some of the claims would be governed by the Montreal Convention, an international treaty that governs carriage of passengers. Under that treaty, injured passengers could be compensated up to $170,000 of strict liability.

“The experience of flying through such a steep drop of altitude is extremely traumatic. Blood rushes to your head and you have a heightened sense of consciousness because of just the concentration of blood in your head. Physically and psychologically these passengers experienced something very serious,” said Rojas.
