Court Confirms Validity of $127M Aircraft Insurance Claims
2025 – A federal judge has ruled against aviation insurers in the $127 million lawsuit brought by Miami-based Carlyle Aviation Partners, represented by Podhurst Orseck, over unpaid claims for aircraft lost as a result of Russia’s invasion of Ukraine.
Judge Schulman determined that the seizure of BBAM’s aircraft in Russia constitutes a physical loss under the applicable insurance policies, allowing the plaintiffs’ claims to proceed. While not directly handling this matter, Podhurst Orseck attorney Pablo Rojas, who is on counsel for Carlyle Aviation Partners in related aviation litigation, noted that the ruling validates the losses suffered by multiple American leasing companies whose commercial aircraft were impacted by the conflict.
