The lawsuit was filed in federal court by the owner of a South Florida restaurant, IT! Italy Ristorante Café & Bar, which is represented by Boies Schiller Flexner LLP and Podhurst Orseck PA. The core of the complaint is that Chubb’s “all-risk” policies did not include a specific exclusion for viruses and therefore should cover the pandemic-related losses. This legal action aims to represent potentially thousands of other policyholders across the country who were similarly denied coverage.
