A consumer advocacy group, Consumer Watchdog, has filed a class-action lawsuit against the insurer Cigna. The suit alleges that a new Cigna policy requiring patients with HIV and AIDS to use its mail-order pharmacy is discriminatory and violates the Affordable Care Act. The lawsuit claims this policy compromises patient privacy, risks delays in receiving vital medications, and prevents personal consultations with pharmacists. This legal action follows a similar complaint filed against Aetna and successful settlements with United Healthcare and Anthem Blue Cross that granted patients the right to opt out of mail-order programs. Represented by attorney Jerry Flanagan, the plaintiff, a man from Fort Lauderdale, argues that opting out would result in prohibitive costs for his medications.
