A Florida federal judge declared the state’s ban on same-sex marriage unconstitutional, marking the fifth such ruling by a judge in Florida. U.S. District Judge Robert L. Hinkle granted a preliminary injunction to bar enforcement of the ban, although the order was temporarily stayed for an appeal. The ruling came in two consolidated lawsuits filed by the ACLU of Florida on behalf of same-sex couples, including those seeking recognition for marriages performed out-of-state. Judge Hinkle’s decision followed what he described as an “unbroken line of federal authority” since the U.S. Supreme Court’s ruling against the federal Defense of Marriage Act. The plaintiffs were represented by attorneys from the ACLU and Stephen F. Rosenthal of Podhurst Orseck PA.
