The family of Jackson Musoni, a Rwandan citizen who died in the March 10, 2019, Ethiopian Airlines Flight 302 crash, filed what is believed to be the first wrongful death lawsuit against Boeing in Illinois federal court. The lawsuit alleges that the Boeing 737 MAX 8 is defective due to its Maneuvering Characteristics Augmentation System (MCAS), which forces the plane into a dive and leaves pilots unable to regain control. The suit, filed by attorney Steven Marks of Podhurst Orseck PA, also criticizes the Federal Aviation Administration (FAA) for delegating too much certification authority to Boeing during the MAX 8’s development. This disaster, along with the Lion Air crash, triggered a global grounding of the aircraft and sparked criminal probes by the U.S. Department of Justice and an audit by the Department of Transportation.
