The Miami-based Podhurst Orseck law firm, despite its small size, has achieved massive success in complex commercial litigation and mass class actions, which now constitute half of its business. Known historically for aviation cases like the Eastern Airlines Flight 401 and ValuJet crashes, the firm has secured over $1.071 billion in settlements from nearly two dozen banks, including Bank of America and Union Bank, for deceptive overdraft fee “resequencing.” Led by partners Aaron Podhurst, Peter Prieto, and Steve Marks, the firm also played a critical role in the mass class action settlement against the NFL concerning concussions, which the league agreed to settle for $765 million. The firm’s ability to compete with much larger defense firms is attributed to its strategic use of technology and co-counsel relationships.
