Aviation lawyer Steven Marks suggests the January 2 runway collision at Tokyo’s Haneda airport was likely caused by a combination of air traffic control and pilot error. The incident involved a Japan Airlines flight, from which all 379 people escaped, and a Coast Guard aircraft, where five of six crew members died. According to Marks, the legal recovery for victims will differ based on whether their travel was domestic or international under the Montreal Convention. He also identifies overburdened air traffic controllers and an increase in near-misses as significant warning signs for the aviation industry.
