A wave of business interruption litigation is growing as business owners sue insurers for denying pandemic-related claims. Plaintiff firms like Podhurst Orseck are selectively taking cases that do not have pandemic or viral exclusions, with partner Steven Marks noting a significant commitment of firm resources to this area. Representing the defense side, Michael Packer of Marshall Dennehey Warner Coleman & Goggin stated that as claims are denied, he anticipates a significant increase in future errors and omissions claims against insurance agents and brokers. According to data from a University of Pennsylvania Carey Law School litigation tracker, around 1,300 businesses had sued their insurers over these issues by early October 2020.
