A federal court in Miami certified a class action lawsuit against Toyota concerning defective heating, ventilation, and air conditioning systems in certain Camry models. The suit, filed in 2018, alleges that the HVAC systems in 2012-2014 non-hybrid Camrys retain moisture, leading to mold growth and foul odors. While U.S. District Judge Federico A. Moreno approved the class for claims under Florida’s Deceptive and Unfair Trade Practice Act, he denied class certification for claims under the Racketeer Influenced and Corrupt Organizations Act. The ruling limits the class to an estimated 91,000 consumers who purchased their vehicles from authorized Toyota dealers in Florida. Attorneys from Podhurst Orseck PA and Kessler Topaz Meltzer & Check LLP will serve as class counsel.
