Developer Turnberry Associates is appealing a court decision in favor of its former executive, Bruce Weiner, whom the company accuses of stealing a lucrative business opportunity. Turnberry alleges that Weiner violated their partnership agreement by secretly partnering with Starwood Vacation Ownership Inc. to develop the St. Regis Bal Harbour Resort, a project the company was also pursuing. Represented by attorney Stephen Rosenthal, Turnberry claims Weiner breached his fiduciary duty, costing them a $40 million opportunity. Weiner’s counsel argues the contract was specifically written to allow partners to pursue outside ventures and that the issue was only raised after the project proved successful following the 2008 economic downturn. The appeal follows a lower court’s summary judgment in favor of Weiner, which Turnberry argues was based on a narrow interpretation of the contract.
