UPS Plane Crash Updates

A wrongful death lawsuit has been filed against the car-sharing service Car2Go following a fatal crash in August 2013. The suit was brought by the family of Irina Reinoso, who was killed when the Car2Go vehicle she was a passenger in ran a red light and collided with a truck. The driver, Mila Dago, faces a drunken-driving manslaughter charge in connection with the incident. The lawsuit, led by Podhurst Orseck partner Ricardo Martinez-Cid, argues that Car2Go should be held liable and is not protected by the 2005 Graves Amendment, a federal law that shields traditional rental car companies from such liability. This case tests the legal distinction between a car-sharing service and a rental car agency, particularly as Car2Go’s model does not involve staff who can assess a driver’s sobriety.
